Presidential Election: Tribunal Fixes July 3 To Rule On PDP’s Application

The Presidential Election Petitions Tribunal has fixed July the 3rd, to deliver ruling on an application filed by the Peoples Democratic Party (PDP) and its presidential candidate seeking to set aside the proceedings of June 11th, 2019.

Chairman of the tribunal, Justice Mohammed Garba says the ruling will determine the next step in the proceedings.

The tribunal during proceedings on Monday reached the decision after parties in the petition had argued their briefs.

Counsel to the PDP Mr Levi Uzoukwu adopted his written address, counsel to President Buhari asked the tribunal to reject the application on the grounds that the said proceedings have been transmitted to the supreme court.

While Counsel to both the Independent National Electoral Commission (INEC) and the All Progressives Congress (APC) also objected to the application, with the APC counsel, Mr Lateef Fagbemi agreeing with the position of the president’s lawyer.

According to Mr Fagbemi, the tribunal can still look at the application but cannot grant it because the law is settled that if a preliminary objection is filed and not argued, it is deemed to have been abandoned.
